The Board met in session at the Linn County Jean Oxley Public Service Center. Present: Chairperson Running-Marquardt, Vice Chairperson Rogers and Supervisor Zumbach. Board members voting “AYE” unless otherwise noted.
Chairperson Running-Marquardt called the meeting to order and led the Pledge of Allegiance.
Motion by Running-Marquardt, seconded by Rogers to approve Consent Agenda as follows:
Resolution 2024-7-99
WHEREAS, the Linn County Board of Supervisors previously adopted, by Resolution 2017- 10-145, dated October 4, 2017, the establishment of stop signs for all-way traffic at the intersection of County Home Road and C Avenue Extension, in section 10-84-7, and
WHEREAS, the investigation of the intersection by the Linn County Secondary Road Department has found that a stop sign is no longer warranted due to the construction of a roundabout, and
WHEREAS, the Linn County Board of Supervisors desires to rescind the previous stop sign Resolution 2017-10-145, dated October 4, 2017.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF LINN COUNTY that the establishment of stop signs for the all-way traffic at the intersection of County Home Road and C Avenue Extension, in section 10-84-7, be rescinded and the Linn County Engineer be directed to remove the stop signs.
Resolution 2024-7-100
RESCIND STOP SIGN RESOLUTION
WHEREAS, the Linn County Board of Supervisors previously adopted, by Resolution 2021- 3-26, dated March 3, 2021 the establishment of stop signs for all-way traffic at the intersection of Echo Hill Road and Alburnett Road, in section 23-84-7, and
WHEREAS, the investigation of the intersection by the Linn County Secondary Road Department has found that a stop sign is no longer warranted due to the annexation into the city limits of Marion, and
WHEREAS, the Linn County Board of Supervisors desires to rescind the previous stop sign Resolution 2021-3-26, dated March 3, 2021.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF LINN COUNTY that the establishment of stop signs for the all-way traffic at the intersection of Echo Hill Road and Alburnett Road in section 23-84-7, be rescinded and the Linn County Engineer be directed to remove the stop signs.
Resolution 2024-7-101
RESCIND STOP SIGN RESOLUTION
WHEREAS, the Linn County Board of Supervisors previously adopted, by Resolution 2021- 3-26, dated March 3, 2021, the establishment of a stop sign for eastbound traffic at the intersection of Elbow Lane and Seven Hills Road, in section 13-86-7, and
WHEREAS, the investigation of the intersection by the Linn County Secondary Road Department has found that a stop sign is no longer warranted due to the private road classification, and
WHEREAS, the Linn County Board of Supervisors desires to rescind the previous stop sign Resolution 2021-3-26, dated March 3, 2021.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF LINN COUNTY that the establishment of a stop sign for eastbound traffic at the intersection of Elbow Lane and Seven Hills Road, in section 13-86-7, be rescinded and the Linn County Engineer be directed to remove the stop sign.
Resolution 2024-7-102
WHEREAS, the Board of Supervisors, hereafter referred to as “the Board”, believes the CST-030-7(221)–5C-57, hereafter referred to as “the project” is in the best interest of Linn County, Iowa, and the residents thereof. The project is defined as turns lanes on Highway 30 to Cedar River Road; and
WHEREAS, the Board has sought appropriate professional guidance for the concept and planning for the project and followed the steps as required by the Code of Iowa for notifications, hearings, and bidding/letting; and
WHEREAS, The Board finds this resolution appropriate and necessary to protect, preserve, and improve the rights, privileges, property, peace, safety, health, welfare, comfort, and convenience of Linn County and its citizens, all as provided for in and permitted by section 331.301 of the Code of Iowa; and
IT IS THEREFORE RESOLVED by Board to accept the bid from Peterson Contractors Inc. in the amount of $416,011.37 and awards the associated contract(s) to the same;
BE IT FURTHER RESOLVED that all other resolutions or parts of resolutions in conflict with this resolution are hereby repealed. If any part of this resolution is adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the resolution or action of The Board as a whole or any part thereof not adjudged invalid or unconstitutional. This resolution shall be in full force and effect from and after the date of its approval as provided by law; and
BE IT FURTHER RESOLVED by the Board of Supervisors of Linn County, Iowa, that after receiving the necessary contract documents, including but not limited to, the contractor’s bond and certificate of insurance, Bradley J. Ketels, Garret A. Redish, Curtis A. Logan, the County Engineer or Assistant County Engineer for Linn County, Iowa, be and is hereby designated, authorized, and empowered on behalf of
the Board of Supervisors of said County to execute the contracts in connection with the afore awarded construction project let through the DOT for this county.
Resolution 2024-7-103
A RESOLUTION APPROVING PETITIONS FOR THE SUSPENSION OF THE COLLECTION OF FISCAL YEAR 2025/ASSESSMENT YEAR 2023 PROPERTY TAXES
WHEREAS, the Linn County Board of Supervisors is this day presented with properly filed, duly sworn petitions for the suspension of the collection of property taxes and/or special assessments pursuant to Iowa Code Section 427.8; and
WHEREAS, the properties for which the assessments against the Petitioners are made lie within Linn County, Iowa; and
WHEREAS, the Petitioners are unable to contribute to the public revenue by reason of age, infirmity, or both.
BE IT THEREFORE RESOLVED by the Linn County Board of Supervisors, this date met in lawful session, that the attached petitions are approved for the Petitioners, parcels, and tax years described as follows:

BE IT FURTHER RESOLVED the Linn County Board of Supervisors orders the Linn County Treasurer to suspend the collection of the property taxes assessed against the Petitioners or the Petitioner’s estates, for the parcels listed above for the tax years as indicated.
Approve and authorize the Chair to sign a Purchase of Service Agreement between Linn County and The Area Substance Abuse Council (ASAC) effective July 1, 2024, through June 30, 2025.
Approve and authorize the Chair to sign a Linn County Children’s Mental Health Assistance Program FY25 Provider Agreement between Linn County and Alicia Gerber LMHC LLC, dba Guiding Light Christian Counseling Center effective July 1, 2024, through June 30, 2025.
Approve and authorize the Chair to sign a Linn County Children’s Mental Health Assistance Program FY25 Provider Agreement between Linn County and Families, Inc. effective July 1, 2024, through June 30, 2025.
Approve and authorize the Chair to sign a Linn County Children’s Mental Health Assistance Program FY25 Provider Agreement between Linn County and Heart & Solutions LLC effective July 1, 2024, through June 30, 2025.

Approve and authorize the Chair to sign an agreement between the Linn County Sheriff’s Office and the Abbe Center for Community Health to provide mental health Services to the Linn County Jail for a total cost of $39,360 for FY25.
Approve and authorize the Chair to sign an agreement between the Linn County Sheriff’s Office and the Islamic Council of Iowa to provide Islamic services for Muslim inmates in the amount of $12,000 from June 2024 through June 2025.
Approve and authorize the Chair to sign an American Rescue Plan Act (ARPA) Subaward Agreement between Linn County and Northwest Neighbors Neighborhood Association for the Shakespeare Garden Revitalization Project in the amount of $15,000.
Approve and authorize the Chair to sign a provider services contract between Options of LInn County and the Mental Health Disability Services of the East Central Region for services effective, July 1, 2025, through June 30, 2027.
Approve and authorize the Chair to sign a provider contract between Linn County and Unity Point Health St. Luke’s Hospital for services provided at Mental Health Access Center, effective July 1, 2024, through June 30, 2025.
Approve the recommendations of the Linn County Opioid Settlement Committee and authorize the Chair to sign respective individual memorandums of agreement to the following organizations:

Approve 5 day Special Class C Retail Alcohol License for Big Town Show Down Truck and Tractor Pull, 812 Iowa Ave., Palo, August 14 through 18, 2024, noting all conditions have been met.
Approve and authorize the Chair to sign a Rezoning Permit Application for property owned by Linn County, located at 1944 County Home Road, to be rezoned from EU-1 (Exclusive Use) to HC (Highway Commercial).
Approve Class B Retail Alcohol License for Bass Farms LLC, 840 Bass Lane, noting all conditions have been met.
Approve Special Class B Retail Native Wine License for Culver’s Garden Center & Greenhouse, 1682 Dubuque Rd., noting all conditions have been met.
Authorize the Chair to sign a Vacancy Form approving a temporary 4th Deputy Auditor for the Linn County Auditor’s Office.
Authorize the Chair to sign a Vacancy Form approving a full-time Collections and Accounting Specialist for the Linn County Sheriff’s Office.
Motion by Zumbach, seconded by Rogers to approve proposed sources and uses of funding for the Secondary Road Headquarters project as follows: ARPA, FEMA, LOST, Dist. 1 Shop, Engineering Building and Fillmore Building sale, Capitol Project Funds, Solid Waste Agency.
Motion by Running-Marquardt, seconded by Rogers to approve minutes of June 26, 2024 as printed.
