The Board met in session at the Linn County Jean Oxley Public Service Center. Present: Chairperson Running-Marquardt, Vice Chairperson Rogers and Supervisor Zumbach. Board members voting “AYE” unless otherwise noted.
Chairperson Running-Marquardt called the meeting to order and led the Pledge of Allegiance.
Motion by Running-Marquardt, seconded by Zumbach to approve minutes of June 25, 2024 as printed.
Motion by Rogers, seconded by Zumbach to approve Payroll claims dated 06-26-2024 for EFT wire in the amount of $10.00; approve claims for Election Workers – checks dated 06/25/2024 #71014842 to #71014853 in the amount of $4,377.19; and ACH in the amount of $106,281.27; for a total of $110,658.46; claims for accounts payable – checks dated 6/26/2024 #71014854 to 71014927 in the amount of $290,025.39; and ACH in the amount of $1,260,084.13; for a total of $1,550,109.52 and approve voided checks in the amount of $1,100.00

Motion by Running-Marquardt, seconded by Rogers to remove the following Resolution from the Consent Agenda and place on the Regular Agenda: Resolution approving an appropriations transfer within the Linn County Fiscal Year 2024 Annual Budget.
Motion by Running-Marquardt, seconded by Zumbach to approve Consent Agenda as follows:
Resolution 2024-6-93
WHEREAS, the following intersection located in Linn County has been reviewed by the Linn County Secondary Road Department, and WHEREAS, it is deemed appropriate to place traffic control signing.
NOW THEREFORE BE IT RESOLVED by the Board of Supervisors, meeting in regular session, and upon recommendation of the Linn County Engineer that the Secondary Road Department place a stop sign at the following locations.
• Stop northbound traffic on Ford Road at the intersection with Rollins Rd in section 26-86-6.
The Board of Supervisors declares these signs to be legal, valid and enforceable and directs the County Engineer to erect said signs in accordance with the provisions of the Code of Iowa.
Resolution 2024-6-94
A Resolution approving a Residential Parcel Split for WINDFIELD SEVENTH ADDITION.
The following description is a summary of Resolution 2024-6-94 as passed and approved by Linn County Board of Supervisors, effective June 18, 2024.
WINDFIELD SEVENTH ADDITION (Case # JF22-0029) to Linn County, Iowa, containing six (6) lots, numbered lots 1 & 2 and Outlots A-D has been filed for approval, a subdivision of real estate located in the SE SW of Section 21, Township 85 North, Range 7 West of the 5th P.M., Linn County, Iowa, described as follows:
WINDFIELD SEVENTH ADDITION TO LINN COUNTY, IOWA, is a subdivision replat of Lot 1 and Lot 2, Windfield Second Addition to Linn County, Iowa and Parcel A, Plat of Survey No. 2684, being part of Lot 1 and part of Outlot A, Windfield Fourth Addition to Linn County, Iowa
Said parcel contains 39.83 acres, subject to easements and restrictions of record.
For a more definite location and description, reference is made to a Final Plat attached hereto and made a part hereof.

Resolution 2024-6-95
APPROVING A PROPERTY USE REQUEST FOR PERMISSION TO UTILIZE THE DR PERCY & LILEAH HARRIS BUILDING FOR THE PURPOSE OF A FREE VISION CLINIC
WHEREAS, Delta Dental, has requested permission to use The Dr. Percy & Lileah Harris Building, for the purpose of conducting a free vision clinic from Tuesday, June 25, 2024 to Thursday, June 27, 2024 and;
WHEREAS, the Linn County Community Services, Linn County Public Health, Linn County Facilities, and Linn County Risk Management have recommended approval of this request,
BE IT THEREFORE RESOLVED by the Board of Supervisors of Linn County, Iowa, that the above request is herewith approved subject to the following conditions:
1. The personnel sponsoring the vision clinic will follow the direction as given by the Linn County employees. 2. The personnel sponsoring the vision clinic will be responsible for seeing that all furniture and items in The Dr. Percy & Lileah Harris Building are returned to the same place they were before the vision clinic started. 3. The personnel sponsoring the vision clinic will oversee the proper conduct of the event.
Resolution 2024-6-96 FISCAL YEAR 2025 BUDGET APPROPRIATIONS
Expenditures cannot exceed the following fiscal year 2025 appropriations by organization:
Approve and authorize the Chair to sign a 60-month lease agreement at $135.50 per month with Gordon Flesch Company for a copier for the Sheriff’s Office.
Approve and authorize the Chair to sign a 60-month lease agreement at $214.58 per month with Gordon Flesch Company for a copier for Home Health.
Approve and authorize the Chair to sign a 60-month lease agreement at $242.28 per month with Gordon Flesch Company for a copier for Public Health.
Approve and authorize the Chair to sign a 60-month lease agreement at $253.52 per month with Gordon Flesch Company for a copier for Public Health.
Approve purchase order PO630 in the amount of $19,800 to Emergent Devices Inc. for the purchase of Narcan to refill vending machines at multiple locations for Public Health.
Approve purchase order PO632 in the amount of $496,888.71 to Insight Public Sector for Microsoft licensing renewal (year 2 of 3) for the IT Department.
Approve purchase order PO635 in the amount of $100,802 to Hoglund Bus Co., Inc. for an ADA accessible Ford Transit 350 for Options.
Approve and authorize the Chair to sign an American Rescue Plan Act (ARPA) Subaward Agreement between Linn County and Hawkeye Area Community Action Program, Inc. (HACAP) for the Linn County SAFE HOME Program for the amount of $268,482.50.
Approve and authorize the Chair to sign a provider service and rate contract between Mental Health Disability Services of the East Central Region and the Linn County Mental Health Access Center for services from July 1, 2024, through June 30, 2025, for the amount of $1,469,600.
Approve and authorize the Chair to sign a deed restriction for the farm portion of the Dows Farm development.
Approve and authorize the Chair to sign an audit engagement letter with Eide Bailly for fiscal year 2024, at a fee not to exceed $72,000.
Approve and authorize the Chair to sign a Memorandum of Understanding MOU between the U.S. Probation Office Northern District and Linn County Family Transformation Service to monitor supervised visits.
Approve an application for a Display Fireworks permit for Gary Peiffer at North Linn Community School Complex, Troy Mills on July 13, 2024, with a rain date of July 14, 2024, noting that all conditions have been met.
Motion by Running-Marquardt, seconded by Rogers to amend Resolution approving an appropriations transfer within the Linn County Fiscal Year 2024 Annual Budget in the amount of $10,000.

A RESOLUTION APPROVING AN APPROPRIATIONS TRANSFER
WITHIN THE LINN COUNTY FISCAL YEAR 2024 ANNUAL BUDGET
WHEREAS, the Linn County Board of Supervisors previously approved the Linn County Fiscal Year 2024 Annual Budget; and,
WHEREAS, it has been determined that it is necessary to transfer appropriations within the Administration service area of said budget; and,
WHEREAS, sufficient appropriations are available to provide for the necessary transfer; and,
WHEREAS, said transfer is within the Administration service area, and is made by resolution of the Board of Supervisors in accordance with Iowa Code Section 331.434(6).
NOW, BE IT THEREFORE RESOLVED by the Linn County Board of Supervisors that appropriations within the Linn County Fiscal Year 2024 Annual Budget are revised as follows:

Mae Hingtgen, CEO of MHDS of East Central Region, presented an update to the Board for the Mental Health and Disability Services of the East Central Region. She recapped legislative changes made resulting in the Administrative Services Organization (ASO). The new law became effective upon enactment on May 15, 2024. As of July 1, 2025, the Mental Health Region will cease. Hingtgen explained in detail a timeline and various aspects of the changes which includes allowing funding for substance use. Proposed maps of the seven Behavioral Health Districts was presented and discussion continued regarding the pros and cons of Johnson and Linn County being in the same district. There is a website to give public input on each map.
Supervisor Rogers thanked Hingtgen for the robust presentation and commended her leadership as well as Jody Bridgewater. He noted that there are a lot of unknowns, and he is very proud of the leadership and her staff. A positive result of this bill is the braiding of the mental health and the substance use funding and he is proud of that direction.
Auditor Joel Miller presented a request for the approval of a temporary fourth Deputy Auditor commencing June 29, through December 31, 2024. He stated that Amanda Hoy has been cross training with Chief Deputy Auditor Becky Shoop for 13 years. Shoop could be retiring next year after 50 years of service and he has been assured that Hoy can perform 100% of her job. He also plans for Hoy to assist in Elections, noting that she has been trained and is SEAT certified. He is looking at this transition beginning this year to elevate Hoy to Deputy so that she can do all the work required of County Clerk and move into Elections this fall, a Presidential Election. Miller stated that he is not running for reelection, and he only has control until the end of his term, December 31, 2024. He is trying to set this organization up to be successful for when he leaves and a fourth Deputy at this time allows for that. He also clarified that they are not backfilling Hoy’s position at this time as the budget will not allow.
The Board thanked Miller for setting up the office for his successor and for the transition plans. They also appreciate that Deputy Shoop has agreed to taking the time off rather than a payout which was her intention all along. The Board expressed their extreme gratitude for Shoop’s 49 years of service and invaluable and institutional knowledge. They also stated that they have complete confidence in Hoy, noting that they have a front row seat with Miller’s staff on a daily basis.
Motion by Running-Marquardt, seconded by Rogers to approve a temporary fourth Deputy Auditor commencing June 29, through December 31, 2024.
Motion by Rogers, seconded by Zumbach to adopt Resolution 2024-6-98
WHEREAS, pursuant to Section 331.903(1), Code of Iowa, Joel D. Miller, Linn County Auditor, has submitted to the Board of Supervisors, Linn County, Iowa, for approval of Amanda Hoy, for appointment as Deputy Linn County Auditor through December 31, 2024, at which time Auditor Miller’s term will end, and WHEREAS, the Board of Supervisors, Linn County, Iowa, finds Amanda Hoy to be qualified to serve as Deputy Linn County Auditor and that the appointment of Amanda Hoy will not exceed the number of deputies authorized for the Linn County Auditor’s Office by the Board of Supervisors, Linn County, Iowa.
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the Board of Supervisors, Linn County, Iowa, that the appointment of Amanda Hoy as Deputy Linn County Auditor by Joel D. Miller, Linn County Auditor, through December 31, 2024, at which time Auditor Miller’s term will end, is hereby approved.
The Board discussed the $15,000 request from the National Czech & Slovak Museum & Library for the NCSML Orloj Clocktower Project that was discussed on Monday.
Andy Whiting, Dir. of Comm. Outreach & Development for the Museum & Library, explained that this is a $1.7 million project to renovate the current clock tower and explained in detail the Prague style and how it is the only one in North America. He explained that they are also pursuing state, federal and local funding and have received a lot of support from businesses as well.
Chairperson Running-Marquardt told a story of meeting folks at the museum that had no Czech heritage or lived in Cedar Rapids. They came special to visit the museum.
Motion by Zumbach, seconded by Running-Marquardt to approve $15,000 of American Rescue Plan Act funding to the National Czech & Slovak Museum & Library for the NCSML Orloj Clocktower Project.
Sonia Evans, Budget & Finance, recapped her presentation to the Board on Monday regarding funding recommendations of the Linn County Opioid Settlement Committee, noting that there were questions about positions and how they will continue to be funded. She explained that the Mental Health Access Center funds are start up costs for one year and the St. Lukes request will be paid by them. The 2 Linn County Deputies will be funded for three years with the potential to be absorbed to vacancies. The Board will approve on Tuesday.
